If the Department of Home Affairs (DoHA) refused or cancelled your visa, there is on occasion a possibility of seeking a review or an appeal of that decision. The Administrative Appeals Tribunal (AAT) – Migration and Refugee Division has the authority to carry out a merits review of certain decisions made by officers of DoHA.
A merits review is the process by which the tribunal reconsiders the facts and law of the original decision. The Migration and Refugee Division of the AAT can affirm, alter or overturn DoHA’s original decision.
The tribunal review is the applicant’s final chance to submit on supporting evidence and the tribunal considers the merits of the case. The review body is compelled by the relevant law when making its judgment.
